The US Court of Appeals for the Fifth Circuit affirmed in part and vacated in part a lower court ruling that the Bureau of Alcohol, Tobacco, Firearms, and Explosives final “frame or receiver” rule targeting privately made firearms without serial numbers conflicts with the Gun Control Act.
“ATF, in promulgating its Final Rule, attempted to take on the mantle of Congress to ‘do something’ with respect to gun control. But it is not the province of an executive agency to write laws for our nation. That vital duty, for better or for worse, lies solely with the legislature,” Judge Kurt D. Engelhardt wrote for the court.

I'm happy about this ruling and the pistol brace ruling as they affirm and the separation of powers.
However, it doesn't mean that those restrictions are unconstitutional, just that Congress has to make those rules.

BTW, I really don't buy into "who" appointed a judge. I place more stock in what party they were a member of.
After John Roberts, judges have been HEAVILY vetted by committees and advocacy groups prior to their name coming across a governor or President's desk.

Kinda not my point.
Whoever is picked by whichever party, you will know how they are going to rule probably 95-99% of the time. Whether the Republicans or Democrats are making the decision, it doesn't matter who is POTUS, but it does matter which party they are in.
Part of the reason I didn't care about Biden saying he would pick a certain gender, sex, or race for SCOTUS. Whoever he chose would rule the same way in the majority of the cases, regardless of race or gender or sex.
Whoever is picked by whichever party, you will know how they are going to rule probably 95-99% of the time. Whether the Republicans or Democrats are making the decision, it doesn't matter who is POTUS, but it does matter which party they are in.

I know, but a guy can dream. It's amazing what we have allowed our country to turn into. Beaurocrats with total disregard for the laws and true nature of the constitution just writing bills to push through congress that are blatantly unconstitutional with no recourse for them doing so. A big part of the reason (in my mind) why we're here is that Congress has abdicated its role in writing actual laws (they're called "the Legislative branch" for a reason) and IA instead letting the Executive branch legislate through regulation and fiat, and then rely on the Judiciary to square things up. While Congress can defer some power to the Executive, it's limited.
But, Congress doesn't want to make laws because they're cowards and don't want to lose re-election. Current Congressional approval rating is 17%. But 98% get re-elected. Does that make sense? A lot of it is because people tend to hate everyone in Congress other than "my Rep/Senator." Nevermind your guy is doing the same junk as everyone else, my guy is good.
Another problem, in my mind, is that nobody is campaigning on policy, but what they're against. You don't know what they are going to do because they're too busy telling you what they will fight. I wonder if they actually have a plan? Couple that with Republicans who are more interested in owning the libs than they are in doing anything, and you don't get anything done.
So, with that kind of gridlock, POTUSes of BOTH parties wind up using executive orders to get stuff done because neither side will do jack for the country.

Which is how it was designed. You will vote for the lesser of two evils because govt is at its heart an evil to freedom and the founders understood that.
IF you decide that Jim Bob is the best guy and you agree with him 100% (if that happens one or both of you are lying BTW) that does NOT meant that I think Jim Bob is any more than a nottheotherparty candidate at best. Thus I am voting the lesser of two evils. I didnt like Trump for quite a few reasons. Gun control was only one. Taking of private land by govt to give to other private citizens was IMHO a lot better reason to not vote for him. However, as the lesser of two evils, and there is NO doubt in my mind that he was the LESSER, I voted for him.
I worked with a guy who was heading up a group for the Constitution party. While I agree that I like their platform a lot better, I told him that they needed to win Dog Catcher before they wasted their time running for Pres. Third parties are dumb asses though

There's been plenty of 3rd party candidates that would be better than what we've been electing but there's a generation of people too scared to vote away from the status quo, typical party lines. And we just keep having groundhog day in the political arena with that form of thinking.
