Is it actually going to happen? Suppressors SBR/SBS?

3 shops are on like to start selling suppressors at midnight tonight with no ATF paperwork. The clock runs out on the chance to file for the govt to stop the court ruling to basically make SBS/SBS and suppressors just normal things again.
Fingers crossed!

In my typical negative fashion, I’ll NOT hold my breath with the “most pro 2A DOJ ever.” The “I’ll reverse all the Biden gun control within the first week, maybe first day.”
And this is NOT a 2nd amendment issue. It’s a matter of law and procedure. The judge laid it out, VERY plainly.
If the orange DOJ chooses to fight this, it says all we need to know. And confirms what I’ve figured all along.
But, I’d LOVE to be wrong.

Well, they didn’t appeal. The stay goes away. Now it’s “legal” to buy NFA items without the BS.
But….
They have 60 days to appeal. Which I fully expect them to. So what happens now, it’s up in the air. Now we wait and see what happens. Luckily the 60 days will be up before the mid terms. Gives us a better chance. If it was after, we’d have ZERO chance of them not appealing. They can’t lose that dangling carrot to string us along.
Gonna be an interesting next few days to see what happens.

So if tomorrow until an appeal gets filed and approved? What happens to every suppressor sold? Made?

Mark Smith's vid today is pretty good - goes into something called the Laches process where basically the DOJ didn't make a peep during the week they had in which to make a peep, so them attempting make an appeal afterwards is unlikely to get any real judicial sympathy.
And like you say, the Republicans need votes, and supporting an appeal would be akin to slitting their own throats. Aside from the religion crowd, gun owners are probably their most consistent supporters - - or at least the most consistent Democrat-opposers.
Brandon Herrera, being pretty high profile and probably packing a fair bit of immunity, along with another guy, filed notice of intent to DOJ to buy a suppressor at midnight tonight without the NFA hoopla and fees. Nice of him to cast the first stone for the rest of us,

Depends on the state you live in, and if you’re a member of the affected suit members. GOA, FPC, maybe the NRA, etc. it applies to current or future members.
Whiiiiich, if this stays in place it will eventually apply to everyone in the free states.
There’s still a lot of uncertainty. I’m very curious.
What’s more curious-er, is let’s say tomorrow cans go on sale with only a 4473 like any other gun. (Cans aren’t guns but Guvco is **** gay. I digress)
Then three weeks later, an appeal is made. Eventually Guvco wins, and all NFA items must again be registered.
What happens to the ones that were sold in the in between times?

It’s time to contact my popularity contest winners with some pretty clear instructions:
Best be on your best behavior, and loudly and strongly tell the DOJ to back the fudge off and let it ride. Be on record. Or I can very easily exercise my right to vote for the write in candidate:Deez Nutz.

And one tonight. I’ll listen n the drive to work tomorrow.

And it *appears* the DOJ is not going to appeal it.

Silencer shop is counting down.
I can't believe this isn't all over the news and social media

Here's a honest question.
Alabama is one of the "free states" listed on Silencer Shop's website
"Silencers are legal in Alabama.
The NFA Form 4 Process is not required in Alabama."
I live about an hour from the Mississippi line. If you remember, I met BigboreShooter there when we were passing around the lead sled. Later I went over there shooting with bear tracker.
"Silencers are legal in Mississippi.
Mississippi still requires the NFA Form 4 process."
So, MS still requires the paperwork, Alabama doesn't. So I take my legally purchased, but not papered, Alabama bought silencer across the state line and get pulled over for speeding. Po Po sees the gun case, opens it, and sees the silencer, "You have your paperwork for this silencer Mr. Ape?"
"Paperwork isn't required in Alabama officer"
"You aren't in Alabama Mr. Ape, I going to need you to step out of the car"
See where I'm going with this? With the hodge podge of states, Can I only cross state lines with my "papered" cans?

That’s a good question.
Another good question, if now they are “regular guns”….
Can I sell a can to an individual in my state?

Mark Smith has spoken a number of times recently on a legal distinction that probably NEEDS to be hammered on in these upcoming 2A fights:
1.
Malum in se: Crimes that are recognized as evil acts by society as a whole - murder, rape, robbery, etc...
2.
Malum prohibitum: actions that are "criminal" only by statute, in which there is no real victim - speeding on an empty interstate, scratching your ass in public, having a B.A.R. resting quietly in your closet, etc...
Our community has been taking it up the ass from malum prohibitum statutes for a very long time, and it might very well be that the courts are starting to see that. A legal attack that heavily uses "
where is the actual CRIME here?" is probably one of the better tools we can deploy.
Yeah, there's some sticky bits, such as not paying your taxes being or not being a
malum prohibitum crime, but we've got a federal constitution that supposedly guarantees the right to keep and bear arms; other federal laws that say otherwise; and laws in some states that make you a felon where in others nobody cares.
When it's clear to a college dropout that this kind of patchwork isn't sustainable, you'd think it would be clear to any non-activist judge.
If nothing else, on this topic we have "Y
ou closed our shooting range because it was too noisy, then threw us in federal prison for screwing an oil filter onto our muzzle. Really? WTF?"

LGS here posted this on the first day freedom. Pretty bold considering all the intricacies of this, but I applaud them.

As I read the rules it probably time to fire up a CNC mill and get on with manufacturing a couple models covering 5.56 and 9. There is high demand with limited supply.
They would make wonderful handcrafted in the USA Christmas gifts!

This sucks for Ohio and a bunch of other states. We've always been pretty pro gun, but have some law that cans and everything on the NFA can only be owned if done so through the federal tax stamp. If they get rid of the stamp, then what? (Even if they're removed from the nfa, they're defined in some way that I dont remember that makes the law still apply at this time)
