US judge tosses machine gun possession case, calls ban unconstitutional

(Reuters) - A federal judge has dismissed charges against a Kansas man for possessing a machine gun, saying prosecutors failed to establish that a federal ban on owning such weapons is constitutional.
“The decision by U.S. District Judge John Broomes in Wichita on Wednesday appeared to mark the first time a court has held that banning machine guns is unconstitutional after the conservative-majority U.S. Supreme Court in 2022 issued a landmark ruling that expanded gun rights.
In that ruling, New York State Rifle & Pistol Association v. Bruen, the Supreme Court established a new test for assessing firearms laws, saying restrictions must be "consistent with this nation's historical tradition of firearm regulation."”
“Morgan was indicted last year on charges that he illegally possessed a machine gun and a machine gun conversion device known as a "Glock switch."
Congress first moved to limit machine guns through the National Firearms Act in 1934, which was enacted after the weapons became commonly used by criminals during the Prohibition Era. It later outright barred possessing them in 1986.
Prosecutors said the weapons at issue in Morgan's case did not fall within the protections of the U.S. Constitution's Second Amendment, which guarantees the right to keep and bear arms for self-defense.
But Broomes disagreed, saying the "the machinegun and Glock switch are bearable arms within the plain text of the Second Amendment."”

He should get to keep his switch. I know that Congress passes laws, but even the NFA and GCA should have been null and void immediately when submitted as a bill.

At least the judge was clear in stating that a machine gun is a bearable arm. Not a lot of wiggle room in the ruling. Should be good case law and make a lot of antis have a cardiac infraction.

Interesting judgement. Your Second Amendment is based; as is a lot of your constitution, on the English Bill of Rights of 1689 which grants us 'the right to bear arms for self defence'. It still holds true. It is just that our Government decides to interpret that right somewhat differently. Be careful!

We now have a Left Wing Socialist Government in charge with a large number of seats in the Houses of Parliament but with only 33% of the electorate vote. Comes from having a large number of political parties which split the voting. 'There may be trouble ahead'. Kier Starmer; now being dubbed Kier Stalin is about the most unpopular person in Parliament but we are stuck with him until the next elections in just under 5 years time. Unless there is a coup in his own party.

And THIS is why every time someone says we are limited by only two parties I shiver. Basically a surefire way to socialism and progressive ideals to take root because they appeal to the largest lazy and morally lax segment of the population, AND those that see it as a straight path to controlling them as a herd.

I hate to say it but France; our old enemy, has a better system where the two top scoring parties in the first round of the election then go head to head and those that voted for the lesser parties can go into the second round in a sort of two tier election.
What happened here was that a new party formed called the Reform party who are anti illegal immigration and they picked up a lot of the vote away from the Conservative party the result being that Labour got in with only 33% of the poll. The previous Labour government under Tony Blair banned hunting of wild mammals with dogs and only allowed it if no more than two dogs were used to flush a wild mammal which must be shot. Traditional fox hunting was therefore banned. Hound packs took to trail hunting with hounds following a scented rag. Starmer has pledged to ban that also now he is in. The constituency area I live in moved from Conservative to Labour and rest assured I will be a thorn in the side of my new M.P.!
